Sweepstakes Rules

‘Play the Jam’ (the “Sweepstakes”)

Entry Period: March 13, 2019 – December 31, 2019

The Jam

SPONSOR: This Sweepstakes is sponsored by ‘The Jam’ 26 N. Halsted (the "Sponsor"), which is solely responsible for the conduct of this Sweepstakes. Apple Inc. is not a sponsor of this sweepstakes.

ENTRY. A purchase is not required to enter the Sweepstakes or win any prize as a Contestant on ‘Play The Jam.’ The Sweepstakes entry period begins Wednesday, March 13, 2019 at 12:00 AM CDT and ends Tuesday, December 31, 2019 at 11:59 PM CT unless extended by ‘The Jam.’ To enter the Sweepstakes, viewers must visit www.CW26Chicago.com and complete an online form to register. Only one (1) entry per person, per email address, per 24-hour period will be accepted (12AM-11:59PM). Each month, twenty (20) entrants will be scheduled to individually appear - one (1) per weekday – as a Contestant on ‘The Jam’ television program during the “Play the Jam” segment between Wednesday, March 13, 2019 and Tuesday, December 31, 2019. All names will be randomly selected using a computer software winner selection tool from all eligible online entries.  Twenty (20) names from the entrant pool per week will be pulled, and will be contacted via email and phone call to schedule appearance for “Play the Jam.”

Twenty (20) Entrants will be scheduled to appear individually as Contestants on ‘The Jam’, Monday – Friday, 6AM – 8AM CT each month of the entry period and will be booked in order of selection. Contestants will have the opportunity to appear on ‘The Jam’ television show to take part in the ‘Play the Jam’ segment. Each weekday, the Contestant will play one of the “Play the Jam” games that are in rotation.  Currently, there are six (6) games that rotate on a monthly schedule for the “Play the Jam” segment: Hot Seat, Rub a Dub Dub…What's in the Tub? Spin & Win, Foxy Boxy Lady, Trivia Toast, and Flap Jack Stack

There are four (4) games that have each have a one (1) in three (3) chance of winning.  These are: Hot Seat, Spin & Win,Foxy Boxy Lady, and Rub A Dub Dub…What’s in The Tub. Two (2) of the six (6) games:  Hot Seat and Spin & Win, have three (3) pre-produced animated versions, each version has one of the three winning options, on the day prior to the broadcast of the “Play The Jam” segment the version of the game video will be selected at random.  During the ‘The Jam’ broadcast, the Contestant will choose one of three options – who or what they think will win, if they select the correct option, the daily prize will be awarded to them as the Game Prize Winner. If they don’t pick the correct option, the Contestant will be considered a Consolation Prize Winner and will be awarded a consolation prize. (Game Prize Winners and Consolation Prize Winners are referred to herein collectively as “Winners.”)  The two (2) other games of chance with a one(1) in three (3) chance of winning in the “Play The Jam” are Foxy Boxy Lady and Rub A Dub Dub…What’s in The Tub?  Rub a Dub Dub…What’s in the Tub? is an interactive game wherein the contestant must choose one of three orange balls from a tub of clear plastic balls.  The two other balls are retrieved by the hosts and all three balls are open at the same time to reveal which one is the winner.  If the contestant has the winner, the contestant wins the Game Prize.  The Foxy Boxy Lady game involves the contestant choosing one of three boxes and inside one of the boxes is print indicating the winner.  The contestant chooses one of the boxes and should the chosen box reveal the winner print, the contestant is a Game Prize Winner. 

One of the other games in the “Play The Jam” rotation is Trivia Toast which is a trivia question presented with three possible answers.  The contestant must select the correct answer to win the daily prize.  The game of skill in the “Play The Jam” rotation is Flap Jack Stack. Contestants will have five (5) chances to toss the pancakes on to a large plate, if 3 of the pancakes land flat on the plate, the contestant will be a Game Prize winner and will be awarded the daily prize.  As with the other “Play The Jam” games, if the Contestant does not win the game the will be considered a Consolation Prize Winner and will be awarded a consolation prize.

Sponsor is not responsible for lost, late, illegible, misdirected or mutilated entries, due to technical/network failures, human error, or any other error or malfunction. Entry materials that have been tampered with or altered are void.

Entrants agree not to upload, post, or transmit any materials which contain any computer viruses, Easter eggs, worms, Trojan Horses or other harmful component or programming routines that are intended to damage, detrimentally interfere with, surreptitiously intercept or expropriate any system, data or personal information. Any attempt to deliberately damage any website or undermine the operation of the Sweepstakes is a violation of criminal and civil laws, and the Sponsor reserves the rights to seek damages from any person who makes such attempt(s).

Any questions regarding the number of entries submitted by an individual or authorized account holder of an e-mail address shall be determined by ‘The Jam’ in its sole discretion, and ‘The Jam’ reserves the right to disqualify any entries by persons determined to be tampering with or abusing any aspect of the Sweepstakes.

ELIGIBILITY. ‘Play The Jam’ is open to all legal residents of Illinois and Indiana who live in the Chicago Designated Market Area (as defined by Nielsen Media Research) and are 18 years of age or older. Former employees and employees of ‘The Jam,’ their advertising agencies, consultants, franchisees, suppliers, (collectively, “Sweepstakes Parties”) are not eligible to enter or win, nor are such current employees’ family members. In addition, individuals who share a common household with a current employee of a Sweepstakes Party or who are in any kind of domestic relationship or partnership with a current employee of a Sweepstakes Party (e.g., boyfriends, girlfriends, fiancé, roommates) are not eligible to enter or win this Sweepstakes. Sponsor shall be the sole judge of what constitutes a domestic relationship or partnership in the event of a dispute.

The winner will first be notified via the email address listed on their entry instructing them to reach out to The Jam staff via phone to confirm they would like to participate in "Play the Jam." As instructed in the initial email, the Entrant must follow up with a phone call to The Jam within three (3) business days. One (1) day before the expiration of the initial email, The Jam staffer will send one (1) reminder email instruction the winner to contact them immediately. If the winner does not confirm receipt of the email via phone, the winner will be considered to have forfeited their opportunity to appear on the broadcast and participate in "Play the Jam."

Odds of being selected as a Contestant will be determined by the total number of eligible entries.

If an Entrant fails to confirm that they will appear as a Contestant on the broadcast within the allotted time period, it will result in the forfeiture of the prize and an alternate Contestant will be scheduled at the discretion of ‘The Jam.’ When the contestant forfeits the prize for the first and second times that the contestant is selected, the contestant is not eligible to be randomly chosen to 'Play the Jam' for thirty (30) days. Should a contestant forfeit the prize a third time, the contestant is ineligible to win an opportunity to 'Play The Jam' for one year from the date of the third selection.

During the follow-up call, the Sponsor will conduct a short discovery interview with the Entrant to gather more information and schedule specific date of appearance. Contestant appearances will be scheduled following the order of selection. Once chosen as a contestant to appear on the show, contestants will be ineligible to enter the sweepstakes again for one (1) calendar year following their confirmed appearance date.

Rescheduling of appearance dates to 'Play the Jam' is prohibited. If one of the scheduled Contestants does not appear on ‘The Jam’ due to a schedule conflict, illness or other reason, it will result in the forfeiture of the prize. Should the contestant notify The Jam of the need to cancel the scheduled appearance within one hour of their appearance, the contestant will be eligible to win another opportunity to Play the Jam in thirty (30) days. Contestants who miss their scheduled appearance for any reason and fail to notify The Jam within one (1) hour leading up to the broadcast will be considered a “no-show” and will be prohibited from entering the “Play the Jam” sweepstakes for one (1) year following their scheduled appearance. Once a contestant appears on "Play The Jam," the contestant is prohibited from winning an opportunity to appear for one (1) year from the date of their appearance on The Jam. Contestants must possess a valid picture ID on the day of their scheduled appearance and sign all release forms to participate in the ‘Play The Jam’ segment.

PRIZES. Each month, twenty (20) winners will be awarded the opportunity to appear live as a Contestant on ‘The Jam’ in the “Play The Jam” segment. If the Contestant wins, they will be considered a Game Prize Winner and receive a prize valued at a minimum of $100. If they do not, the Contestant will be considered a Consolation Prize Winner and will receive a consolation prize valued at approximately $25.

The Game Prizes scheduled for the Entry Period are listed below. Please be advised that the listed prizes are for the current round of the “Play The Jam” entry period, and are subject to change without notice at the sole discretion of the Sweepstakes Sponsor (in which case a prize of equal or greater value will be added):

DAILY PRIZE DETAIL

PRIZE RESTRICTIONS & CONDITIONS. Prizes are non-transferable and will be delivered no later than 6-8 weeks after the Winner appears on the show. Deliveries are at the expense of Weigel Broadcasting Co. and will be sent to the Winner based on the best method of delivery. Method of delivery is to be determined at the sole discretion of Weigel Broadcasting Co. Prizes are subject to terms and conditions of the Prize provider and Sweepstakes Parties. No substitution or cash redemption by Winner of any prize is permitted. All income and other taxes are the responsibility of the Winner. By entering, the Winner is consenting to the use of their name, likeness, and/or biographical information for advertising and promotional purposes without additional consideration, including any in studio appearances.

DISCLAIMER OF LIABILITY. Winners are responsible for income and other taxes on the prize. The Winner will be required to sign and return an Affidavit of Eligibility, Release of Liability, Publicity Release and Letter of Indemnification on the day of their appearance on “The Jam.” Failure to comply with the rules and conditions of the Sweepstakes will result in a forfeiture of prize.

‘The Jam’ and Sweepstakes Parties explicitly disclaim any and all warranties of any kind, including but not limited to, implied warranties of merchantability, fitness for a particular purpose, and non-infringement. The Sponsor and/or Sweepstakes Parties shall not be liable or responsible for those guarantees or warranties made or offered by advertisers, partners, manufacturers or suppliers, including those related to the Prize. Under no circumstances shall the Sponsor and/or Sweepstakes Parties be held responsible or liable for use of the information and/or products supplied and/or made available through the promotion or for errors or anomalies resulting in the unintended or erroneous participation, award of any prize or other benefits under the jurisdiction of these sweepstakes rules.

By participating in this Sweepstakes, all participants and Winners agree that the ‘The Jam’ and the Sweepstakes Parties their partnerships, subsidiaries and affiliates and each of such entities’ respective officers, directors, agents and employees are not responsible or liable for any injury, loss, illness, litigation or damage that may occur from participation in the Sweepstakes or acceptance, possession, use or misuse of prize. In the event that any dispute arises regarding the meaning or interpretation of these official rules, participants agree that the dispute shall be resolved by applying the laws of Illinois and that it shall be resolved by and within the state or federal courts of that state.

The Sponsor and Sweepstakes Parties offer no assurances, warranties, or guarantees that the promotion in any media, including but not limited to on air, text/mobile phones and websites, will be uninterrupted or error-free and do not promise the accuracy or reliability of any information obtained through this sweepstakes. The Sponsor and Sweepstakes Parties will not be liable, and are not responsible, for damages of any sort connected to participation in or inability/failure to participate in the sweepstakes, whether the damages are direct, indirect, special, incidental, or consequential. Apple Inc. is not a sponsor of this sweepstakes.

MISCELLANEOUS. The decisions made by ‘The Jam,’ concerning any and all matters with respect to this Sweepstakes shall be final. In the event of a computer, telephone failure, or any other circumstances beyond the control of ‘The Jam’ where it becomes impracticable to award one or more prizes, ‘The Jam’ may, in its sole and absolute discretion, determine not to award any such prize. This Sweepstakes is void where prohibited, penalized or otherwise restricted by law. A copy of these official Sweepstakes rules are available at the ‘The Jam’ offices located at 26 N. The Jam will maintain a list of all Game Prize Winners and Consolation Prize Winners up to six (6) months prior to the current Entry Period.
